Huawei's CFO Meng requests change in sureties for bail conditions

Chinese telecommunications giant Huawei Technologies Co Ltd Chief Financial Officer Meng Wanzhou arrived on Tuesday for a hearing before a Canadian court in a case that has strained Beijing's ties with Canada and the United States.

The charges against Meng, filed in federal court in NY, allege that between 2007 and 2017 she, Huawei and the subsidiaries sought to mask their business with Iran in violation of U.S. and United Nations sanctions on the country.

The judge allowed Meng to restore realtor Robert Cheng and his wife as sureties.

Meng Wanzhou, the chief financial officer of the company, is seeking to vary the conditions of bail imposed by B.C. Supreme Court Justice William Ehrcke following a three-day hearing in December.

Meng, who was arrested last month in Canada and faces extradition to the U.S., is charged with bank fraud, wire fraud, and conspiracies to commit bank and wire fraud.

Meng's bail terms include wearing an ankle monitor, remaining inside her home between 11 p.m. and 6 a.m. and around-the-clock surveillance.

Huawei stands accused of several crimes, including a conspiracy to steal trade secrets from T-Mobile, more than half dozen counts of wire fraud, and obstruction of justice.

The US further alleges that, aside from emails that illustrate these actions, Huawei implemented a "bonus program" in 2013 that incentivized employees to steal competitors' secrets.




With the request made official, lawyers with Canada's Department of Justice must determine, within 30 days, whether an "Authority to Proceed" will be issued.

"Huawei engineers violated confidentiality and nondisclosure agreements with T-Mobile by secretly taking photos of "Tappy", taking measurements of parts of the robot, and in one instance, stealing a piece of the robot so that the Huawei engineers in China could try to replicate it", writes the DOJ.

In Ottawa, Public Safety Minister Ralph Goodale said Canada's decision on whether to ban Huawei from supplying equipment to 5G networks is "some ways off into the future". Her case has set off diplomatic spats between the United States, China and Canada.

Huawei is yet to comment on the charges.

One of the USA indictments singled out Huawei's Chief Financial Officer Wanzhou Meng, also known as "Sabrina Meng".

"Today we are announcing that we are bringing criminal charges against telecommunications giant Huawei and its associates for almost two dozen alleged crimes", acting Attorney General Matthew G. Whitaker said.

Days after Meng's arrest, the private company that dominates United Kingdom telecommunications, BT Group, announced it was from its existing mobile networks, and would not use Huawei technology in future mobile systems.

Speaking at a press conference where the charges against Huawei and Meng were unsealed, U.S. Commerce Secretary Wilbur Ross said the Trump administration is taking a tougher stance against those who violate trade sanctions.
