SCI Refuse To Accept West Bengal's Petition Filed Against Aadhaar Act

Supreme Court on Monday declined West Bengal counsel's plea challenging Centre's decision to make Aadhar Mandatory.

A bench headed by Chief Justice Dipak Misra said this after Attorney General K K Venugopal told the court that the government would be amenable to various Aadhaar cases pending before the court being decided by a Constitution bench, instead of the Supreme Court passing any interim orders.

Justice Sikri asked Sibal: "In a federal structure, how can a State file a plea challenging Parliament's mandate? Let Mamata Banerjee come in her individual capacity, if she so wishes", the court said. The government has set the deadline for February 2018 for all the citizens to link their UIDs with their phone numbers. "We know it is a matter which needs consideration, but you satisfy us how a state can challenge it (sic)?"

The Mamata Banerjee government has terminated licences of three diagnostic centres of North 24 Parganas, one of the worst dengue-affected districts in West Bengal.

Several petitions are pending in the top court which challenge the centre's move to make Aadhaar linkage with mobile number and bank accounts mandatory for welfare schemes and notifications.




The Centre hinted that those who have Aadhaar will have to link with government welfare schemes by December 2017.

The plea is listed for hearing before a bench comprising Justices AK Sikri and Ashok Bhushan today. Article 32 can not be agitated by a State against the Centre, a technicality that the state government's counsel, senior advocate Kapil Sibal, seems to have overlooked while moving the apex court which in turn led the top court to rap Banerjee's government.

The Court ordered this while hearing the Plea against linking Aadhar number with mobile numbers.

The court asked the Centre to file its response on the plea in four weeks. While the critics of Aadhaar welcomed the ruling, the government argued against it saying that right to privacy comes with reasonable restrictions, and Aadhar should be included.
