Timothy Loehmann, the Cleveland police officer who fatally shot 12-year-old Tamir Rice in 2014, was sacked on Tuesday after rules violations, the city's police department said.
The officer who was with Loehmann when Rice was shot, Officer Frank Garmback, will be suspended for 10 days starting Wednesday - and will be required to attend additional tactical training - after being found guilty of rules violations relating to tactics deployed that day, McGrath said.
Officer Loehmann, who shot and killed the 12-year-old, was sacked Tuesday for inaccuracies on his job application, while Officer Garmback, who drove the patrol auto, was suspended in the case for violating a tactical rule.
Rice had been playing with what looked like a gun in a park near his home when someone called 911 to report him.
Loehmann, who shot Rice, was sacked not for something related to the shooting, but because of inaccuracies on his application form, Williams said.
12-year-old Tamar Rice was shot by Loehmann on November 22, 2014, and his death caused an uprising by the Black Lives Matter movement.
Loehmann fired his gun less than three seconds after arriving at the scene.
Officer Who Killed Tamir Rice Fired For Rule Violations On Job Application
"The evidence clearly shows that these gentlemen did not do anything illegal", Cleveland Police Patrolmen's Association president Steve Loomis told reporters. The officers on the scene, Loehmann and Frank Garmback, hadn't delivered first aid, a role left to an Federal Bureau of Investigation officer who happened to be nearby.
A message was left with the police union about the discipline. "Garmback should be fired too, for his role in pulling up too close to Tamir".
According to Cleveland police, Loehmann's job application contained inaccuracies and he violated other administrative policies. This is the reason that was given for Loehmann's firing, rather than anything related to the Rice shooting.
A subsequent criminal investigation by local prosecutors closed a year and a half ago, without bringing charges against the two officers. The caller said Rice was "probably a juvenile" and the weapon was "probably fake", but the officers were not given that information.
Video surveillance showed he fired his weapon two seconds after leaving the patrol auto.
