Delhi HC clears IT probe against Sonia, Rahul in National Herald case

The BJP welcomed the Delhi High Court's refusal to stay income tax proceedings against a company involving Congress leaders Sonia and Rahul Gandhi and said the case had serious ethical and moral dimensions. "It is better you withdraw it and approach the income tax assessing officer", the court told the firm, which had challenged a lower court order.

But, as the company has not even approached the assessing officer, it should submit documents before the department.

Dr. Swamy had alleged that they had fraudulently acquired Associated Journal Ltd. (AJL), that used to publish the now defunct National Herald newspaper and transferred its assets worth crores of rupees to Young Indian.

According to IT records, 83.3 per cent of Young Indian was held by Sonia and Rahul, 15.5 per cent by Congress leader Motilal Vora and the remaining 1.2 per cent by Oscar Fernandes.

"We are not inclined to entertain your writ petition". Mr Singhvi said the court had stated that all the points of law that had been raised in the petition can be raised in front of the assessing officer of the income-tax department.

In August, the court issued notices to Sonia, Rahul and five others on Swamy's application seeking presentation of certain documents from AJL and Indian National Congress (INC) in connection with the National Herald case.




Sonia, Rahul, Vora (AICC treasurer), Fernandes (AICC general secretary), Dubey and Pitroda were summoned for alleged offences under section 403 (dishonest misappropriation of property), 406 (criminal breach of trust) and 420 (cheating) read with section 120B (criminal conspiracy) of the IPC.

The AJL, which originally owed Rs 90 crore to the Congress party, became a fully-owned subsidiary of Young Indian by virtue of this decision and transaction. Subramanian Swamy is not inchare of I-T.

At one point, when Congress lawyers insisted that the judges send a notice to the I-T Department, the Bench observed, "Don't be so arrogant". The court had summoned the accused persons, besides YI on 26 June, 2014.

Unfazed by the development, the Congress asserted it was proud to be associated with the National Herald and blamed the media for misrepresenting the facts. This was on a private complaint filed by senior BJP leader Subramanian Swamy.

In a bid to keep AJL afloat, the Congress party gave the company unsecured, interest-free loans for some years up to 2010.

The Congress leaders have been accused of cheating and misappropriation of funds.
