More Than 50 Tech Companies Take On Trump's New Travel Ban

A hearing in a separate lawsuit by Hawaii is scheduled for Wednesday.

The attorneys general argue that the revised ban retains the unconstitutional components of the original order, including a broad ban on entry by nationals from several predominantly Muslim countries and a suspension of the refugee program.

Hawaii filed its lawsuit two days after the new ban was announced, arguing that the order violates the U.S. Constitution and would have a "chilling" effect on the state's tourism industry.

Californias lawyers said the state, whose population is 27 percent foreign-born, is home to almost 700 students from the six targeted countries at its state universities and would face the loss of prospective students, scholars and physicians from overseas, as well as millions in tax revenue from travelers.

For some context, the first travel ban attempted to restrict travel from seven Muslim-majority nations while the current proposal aims to restrict travel from six: Iran, Libya, Somalia, Sudan, Yemen and Syria for 90 days. The plaintiffs are unnamed and were not in court because many are USA citizens trying to bring in family members who are trapped in covered countries.

The states collectively will also be filing around 50 new "declarations" setting forth numerous harms they claim to face under the new executive order, which is slated to go into effect on Thursday.

But Watson stopped short of ruling immediately on Hawaii's request for a a temporary restraining order, saying instead that he would issue a written order by 6 p.m. Wednesday.

Higher-profile technology companies, like Apple, Amazon and Microsoft who signed onto the amicus brief in support of the State of Washington's case against the last travel ban, have not put their names on the new version.




Robart said there would be no hearing before Wednesday and asked the Justice Department for a response to Ferguson's motion.

And that goal, the states contended, is to “disfavor Islam and favor Christianity.”.

"Bans like those included in this order are harmful to USA national security and beneath the dignity of our great nation", the letter read.

The order also poses new concerns, including by requiring relevant federal agencies to collect and publish information about convictions of terrorism-related offenses, government charges of terrorism, and gender-based violence against women committed by foreign nationals, while containing no corresponding publication requirement for US citizens.

The Trump administration, to be sure, will defend the revised EO by claiming that religion is not the motivating factor and that the ban on immigration from the six countries is based on national security considerations.

The White House reworked the first executive order to address some of the issues that came up in court, but the main points are largely the same.

The Justice Department argued that Hawaii can't claim it's harmed so it doesn't have standing to bring the case.

Attorneys representing the state said the order is just as discriminatory against Muslims as the first one and that it still violates both the US constitution and federal laws. Indeed, the Trump administration could seek to use this information to lay the groundwork for further bans or restrictions on immigration. Dianne Feinstein, D-Calif., and 36 colleagues introduced a bill that would negate Trumps order, legislation that has little prospect of success in the Republican-controlled Congress and even less of winning the presidents signature. It seeks to clean up some glaring instances of executive overreach to defeat legal challenges, while keeping the underlying policy of discriminating against Muslims intact.
