Transgender Reaassignment Surgery Under Obamacare Blocked by Judge

Judge Reed O'Connor sided with eight states, including Texas, as well as Christian healthcare providers, who had taken issue with legislation extending sex discrimination to include "discrimination on the basis of gender identity and termination of pregnancy".

O'Connor's injunction comes just one day before the new policy was going to be put into effect.

In August 2016, the state of Texas sued the federal government, arguing that the regulations would force doctors to perform abortions or do gender-transition procedures on children even if doing so violates their religious beliefs.

Meanwhile, an HHS spokesperson said the agency was "disappointed by the court's decision to preliminarily enjoin certain important protections against unlawful sex discrimination in our health care system". "Today's ruling ensures that doctors' best medical judgment will not be replaced with political agendas and bureaucratic interference".

Texas federal judge made a ruling on Saturday that halts the protection of transgender health and abortion-related services.




The court order, brought by the states of Texas, Wisconsin, Nebraska, Kansas, Louisiana, Arizona, Kentucky, and MS, along with three Christian-affiliated groups, stated that the Health and Human Services department's regulations prohibiting doctors from discriminating on the basis of gender identity, or against women seeking abortions, violated practitioners' religious freedom.

A federal judge has issued an injunction against a rule barring anti-trans discrimination in health care. The ruling marks an extreme extension of the dubious logic behind the Supreme Court's Hobby Lobby decision-and indicates that conservative courts believe the purported right of health care professionals to discriminate against patients trumps patients' right to sound medical treatment. The firm is also known as Becket Law.

"This is another predictable, baseless ruling by a judge who state officials handpicked to deliver a ruling against transgender people", said National Center for Transgender Equality's Executive Director Mara Keisling in a statement. "What the doctor can't do is say, 'I won't treat you because you're transgender'". The judge may be right about that, but it really doesn't matter, because the rule in question does not require anybody to perform or insure abortions. "Transgender people who are turned away when they are sick, injured, or otherwise need health care, or are denied insurance coverage they've earned or paid for can still seek legal redress in the courts".

Title IX - a federal law that bars sex discrimination in federally funded education programs and activities - "unambiguously prevented discrimination on the basis of the biological differences between males and females", O'Connor wrote, thereby ruling it did not include gender identity.
